1 Year Limited Warranty Agreement

 Upscaled Inc. ("Upscaled") warrants to the original end-user customer ("Customer") that the refurbished consumer electronic products ("Product") sold by Upscaled will be free from defects in materials and workmanship under normal use and service for a period of one (1) year from the date of purchase by the Customer (the "Warranty Period").

 This limited warranty applies only to the Product purchased by the Customer from Upscaled or an authorized reseller, and is not transferable. Upscaled's obligation under this limited warranty is limited to repair or replacement of the Product, at Upscaled's sole discretion.


How to get service warranty claim?


To make a warranty claim, the Customer must contact Upscaled at support@upscaledinc.com or by visiting our website at www.upscaledinc.com within the Warranty Period. The Customer will be required to provide a copy of the original purchase receipt or other proof of purchase, as well as a detailed description of the defect. The customer should also provide the product serial number and other necessary documentation that Upscaled may require. Upscaled will not be responsible for any costs or expenses incurred in returning the Product to Upscaled for warranty service.


Upscaled will, at its discretion, repair or replace any defective Product during the Warranty Period. All Products that are replaced will become the property of Upscaled. Replaced Products will be covered by the remaining portion of the original Warranty Period. Repaired or replaced Products will be shipped to the Customer freight prepaid.


This limited warranty does not cover:

  • damage resulting from accident, abuse, misuse, or modification of the Product
  • damage resulting from improper maintenance or repairs
  • damage resulting from use with non-Upscaled products
  • cosmetic damage
  • normal wear and tear

 The customer should also note that Upscaled will not be responsible for any special, indirect, incidental, or consequential damages, including but not limited to loss of business, revenue, or profits, whether based on contract, tort, or any other legal theory, arising out of or in connection with the use or inability to use the Product, even if Upscaled has been advised of the possibility of such damages.

 This limited warranty is the only express warranty provided by Upscaled and is in lieu of all other warranties, whether express, implied, or statutory, including but not limited to, any implied warranty of merchantability or fitness for a particular purpose.

 No Upscaled dealer, agent, or employee is authorized to make any modification, extension, or addition to this warranty.


 Governing Regulation


This limited warranty gives the Customer specific legal rights, and the Customer may also have other rights that vary by state, province or country.

This limited warranty shall be governed by and construed in accordance with the laws of the state of Denver, USA without giving effect to any principles of conflicts of laws.

This limited warranty constitutes the entire agreement between Upscaled and the Customer with respect to the Product and supersedes all prior or contemporaneous oral or written communications, proposals, representations and warranties.
